Lasting Powers of Attorney

Helping you stay in control of the decisions that matter most.

What is a Lasting Power of Attorney?

A lasting power of attorney (LPA) gives another individual the legal authority to look after specific aspects of your financial affairs or health and welfare should you lose the capacity to do so.

They are not just for the elderly; younger people may become incapacitated through accident or illness.

If you do not have an LPA in place and later become mentally incapacitated, relatives may face long delays and expense in applying to the Court of Protection to get access and take control of your assets, finances and welfare.

What decisions can an attorney make on your behalf?

Many people can be surprised by the level of responsibility an attorney may have. Depending on the type of LPA you have in place, they may be responsible for important financial decisions, or decisions related to your health.

Property and Finance LPA

  • Banking:
Full management of your bank or building society accounts.

  • Bills:
Paying utlity bills, managing your mortgage payments or handling care fees.

  • Property:
Buying, selling or renting out property, maintenance and repairs arrangements.

  • Income and Benefits:
Managing your state benefits or pensions.

  • Taxes: Managing your tax obligations, looking after your investments, and arranging gifts on special occasions like birthdays or Christmas.

Health and Welfare LPA

  • Residencial Arrangements:
Deciding where you should live (e.g. remaining at home or moving to a care home).

  • Day-to-day arrangements:
Managing your daily care routine, dietary requirements and personal activities.

  • Medical Treatment:
Deciding on your medical treatments and care plans, including medical trials and ‘Do Not Resusitate’ instructions, though only if it is clearly stated in your LPA document.

  • Relationships:
Deciding who may or may not have contact with you.

Understanding what an attorney can do is only part of the picture. Choosing the right person to take on that responsibility is equally important.
